Why can't people resident in The Netherlands open a Holding with GoldMoney?



The Autoriteit Financiële Markten (AFM), the Netherlands financial regulator, is of the opinion that GoldMoney “offers investment objects”, which is not allowed in the Netherlands without a license according to Section 2:55 of the Netherlands Financial Supervision Act (Wet op het financieel toezicht, Wft). We disagree with the AFM’s assessment and have decided not to apply for a license as we do not want to subject ourselves, and by extension our customers, to unnecessary and unpredictable regulatory requirements.

GoldMoney is already registered to operate as a Money Service Business in Jersey, Channel Islands. We are regulated by the Jersey Financial Services Commission (JFSC), which is the main regulatory body for Jersey’s globally recognised financial services industry. We therefore comply with world standard regulation and requirements.

Why are some of your competitors still offering their services in the Netherlands?

We cannot speak for other companies. We are unaware if they have also been approached by the AFM.
